Payroll Compliance in Texas
Texas has no state income tax, which simplifies one layer of payroll compliance. However, Texas employers are still responsible for federal payroll tax deposits and filings, Texas Workforce Commission (TWC) quarterly wage reports and unemployment tax (FUTA/SUTA), workers’ compensation compliance, correct employee versus independent contractor classification, and timely W-2 and 1099 distribution each January.

Most payroll software platforms and national payroll vendors process transactions — they do not provide advice. What is the penalty for late payroll tax deposits in Texas?
The IRS applies a tiered penalty for late federal payroll tax deposits: 2% if one to five days late, 5% if six to fifteen days late, 10% if more than fifteen days late, and 15% if the deposit is not made within ten days of the first IRS notice. These penalties apply on top of any interest that accrues. Staying on the correct deposit schedule is one of the most important things a business owner can do to avoid unnecessary IRS exposure.
How do I know if my workers should be employees or independent contractors?
The IRS uses a multi-factor test based on behavioral control, financial control, and the nature of the relationship. Texas employers who misclassify employees as contractors face back payroll taxes, interest, and penalties from both the IRS and the Texas Workforce Commission. If you are uncertain about a worker’s classification, we can review the relationship and give you a clear answer before it becomes a problem.
Can you take over payroll from our current provider?
Yes. We handle payroll transitions regularly. We will request your historical payroll data, verify year-to-date figures for every employee, and ensure continuity so there is no disruption to your team’s pay schedule.
Do you handle payroll for businesses with employees in multiple states?
Yes. Multi-state payroll requires registering in each state, withholding the correct state taxes, and filing returns in each jurisdiction. We handle multi-state payroll for DFW-based businesses with employees or locations outside Texas.
What records do I need to keep for payroll compliance?
Federal law requires employers to retain payroll records for at least three years and tax records for at least four years. This includes employee W-4s, I-9s, time records, pay stubs, and tax filings. We maintain organized records for all payroll clients as part of our service.
